Abstract
The historical materials show that the Chinese word of custody is the outcome of the introduction of western law in the late Qing Dynasty.This concept contains a special legal and cultural origin and is the important embodiment that the modern custody system was established in China.The measures depriving of or confining fully bodily freedom before the late Qing Dynasty were not the modern custody system because they did not contain the legal and cultural origin of custody.The modern custody system of new China has disappeared because of the shortage of the essence and core of the modern system of custody.
