In Colombia, the action of guardianship is the protection mechanism for the defense of the rights of the persons with disability in topics as health, work and education, with the intention of advancing towards a real and effective equality, besides achieving their inclusion in a generally exclusive society. However, in the juridical practice, the effectiveness of this constitutional tool even presents some obstacles. In this regard, the objective of the article is focused in two (2) ways: first, to highlight the importance of the action of guardianship in the contemporary Constitutional State; and second, to determine its effectiveness in the social reality, specifically of the persons with disability in the municipality of Santa Rosa de Cabal (Risaralda). The methodology is deductive, following descriptive and analytical bosses.
